Public Beta Terms

Last updated: October 4, 2026

These Public Beta Terms supplement our Terms of Service for the pre-release Lecture Hat Services. The Public Beta provides early access so we can develop, build, and improve the product for general use. By accepting these Beta Terms when registering or otherwise accessing the Public Beta after they are presented to you, you agree to them. You must be at least 18.

Pre-release software may contain defects, become unavailable, or lose content. Keep an independent copy of material you need. Paid-subscription refunds and mandatory rights continue to apply.

1. Product Access and Participation

While your participation continues and you comply with the applicable terms, you may use the Public Beta for your personal or internal organizational purposes. You may report bugs or offer suggestions, but there is no required feedback schedule and no employment, partnership, or compensation arrangement.

A Course Pilot is governed exclusively by the Pilot Terms you accept for in-course activity. These Beta Terms apply outside that course only if separately accepted. An executed DPA controls the personal data it covers, and the Privacy Policy remains the factual processing notice.

2. Experimental Features and Availability

Beta features are experimental and provided "as is." We may modify or remove experimental features and may end the Public Beta without making it generally available. We do not promise an uptime percentage, support-response time, future release, or migration path unless a separate written agreement expressly provides one. Statutory duties and the refund rights below are unaffected.

3. Fees and Refunds

The free plan requires no payment method. If you elect a paid plan, you pay the disclosed fees and the complete Refund & Subscription Policy applies. We will not convert free beta access into a paid Subscription without your affirmative enrollment.

Changes to paid pricing require the applicable advance notice. If discontinuation or a material reduction affects a material part of a paid Subscription, or we end paid access for reasons other than your breach, Terms Sections 11.2 and 17.1 preserve the refund of prepaid unused fees. A beta disclaimer does not defeat a promised refund or mandatory consumer remedy.

4. Feedback and Intellectual Property

You may, but are not required to, provide Feedback about the product. You give Feedback "as is" and grant the license stated in Terms Section 6.3 so Lecture Hat can use suggestions freely to develop and improve the product without compensation. Do not send Feedback containing a third party's confidential information or rights you cannot license.

Lecture Hat retains its rights in the product, including features created in response to Feedback, whether developed before or during your participation. Your private notes, recordings, and documents remain Your Content; they are not Feedback merely because you create them in the beta. Content ownership, processing permissions, and no-training commitments remain as stated in the Terms and Privacy Policy.

5. Public Discussion and Confidential Information

You may publicly describe and show your use of the Public Beta, subject to others' rights and the Acceptable Use Policy. Participation itself is not confidential. If we separately identify non-public information as confidential when providing it to you, use it only for participating in the beta and protect it with reasonable care.

That duty does not apply to information you already knew without a confidentiality obligation, information made public without your fault, information properly received from another source, or information independently developed without using the confidential material. You may make a legally required disclosure. When lawful and practicable, give us advance notice so we can seek confidential treatment. Feedback is not confidential merely because you submit it.

6. Responsible Use and AI Output

The Acceptable Use Policy, Recording Consent, and AI Use Disclosure apply within their scopes. AI results may be incorrect or fabricated, and require human review. You are responsible for required recording permissions, rights in submitted materials, academic-integrity rules, and whether material may be uploaded under your institution's policies.

Individual beta participation and an academic email address do not establish an institutional agreement, a FERPA school-official relationship, or endorsement by a university. A separate executed institutional agreement is needed for institutional processing duties.

7. Term and Termination

These Beta Terms start when you accept them and continue while you participate. You may stop at any time; Subscription cancellation and account deletion use the controls described in the Terms. We may suspend or end participation under Terms Section 11, including its notice and opportunity-to-address provisions where practicable and lawful.

When participation ends, the beta access license ends. Content handling follows the Privacy Policy. Feedback licenses, intellectual-property rights, any applicable confidentiality obligation, accrued payment obligations, and the dispute and liability provisions survive as needed to give them effect.

8. Disclaimers, Liability, and Disputes

Lecture Hat disclaims warranties for the Public Beta to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The controlling limits and exceptions are in Terms Sections 12 and 13. These Beta Terms do not create another liability cap or exclude duties that cannot lawfully be excluded.

Terms Sections 15 and 16 govern applicable law and disputes, including binding individual AAA arbitration, the class-action waiver, and the 30-day opt-out. Course Pilot Terms and executed institutional agreements govern their respective scopes as stated above.

9. Changes and Contact

Changes to these Beta Terms follow Terms Section 17.2, including prospective effect, material-change notice, and the cancellation/refund right. The precedence rules in Terms Section 19.2 apply. Send questions or defect reports to the contact below.
