Lecture Hat respects others' copyrights and asks users to do the same. This Policy explains how to report material available through Lecture Hat and how a user may respond to removal based on a copyright notice. It follows the notice-and-counter-notice process in 17 U.S.C. § 512.
Send copyright notices and counter-notices to: Copyright Notice Agent, Lecture Hat, Inc., 7710 SW 67th Ave, South Miami, FL 33143-4532, USA. Telephone: +1 305 606 0188. Email: [email protected], with the subject "DMCA Notice" or "DMCA Counter-Notice."
Identify the exact Lecture Hat material, reference, or link at issue. We cannot delete material hosted by another provider, but a notice may ask us to remove or disable a reference or link on Lecture Hat that directs users to infringing material. Identify where the reference or link appears on Lecture Hat and the material it points to. You do not need to contact the uploading user before submitting a notice.
Consider whether the use is authorized by the owner or by law, including fair use. Lecture Hat can be used for study, commentary, or research; the presence of a copyrighted work does not by itself establish infringement. If you are uncertain, consider obtaining legal advice before asserting infringement.
A notice may be shared with the user who made the material available so they can understand and respond to the claim. Submit only the information needed for the process. Under Section 512(f), knowingly and materially misrepresenting infringement or mistaken removal may result in liability for resulting damages, costs, and attorneys' fees.
A notice must contain:
After receiving a notice that substantially complies with the DMCA, we respond expeditiously by removing or disabling access to the identified material and make a reasonable effort to notify the user who supplied it. We may seek missing information when a notice is incomplete. A copyright complaint does not automatically require removal of unrelated material or termination of an entire account.
If material was removed or access disabled because of mistake or misidentification, the user who supplied it or their authorized agent may send a counter-notice to the contact in Section 1. It must contain:
We send a copy of a qualifying counter-notice, including its contact information, to the original notifying person. That person may seek a court order. Unless our copyright contact first receives notice that the notifying person has filed an action seeking to restrain the alleged infringement, the DMCA process provides for replacing the material or restoring access not less than 10 and not more than 14 business days after receipt of a qualifying counter-notice. Restoration does not authorize material independently prohibited by law or the applicable use policy.
We maintain a policy providing for termination in appropriate circumstances of users who repeatedly infringe copyright. We consider valid notices, successful counter-notices, withdrawn or rejected claims, and other relevant information rather than treating every accusation as a finding of infringement. We accommodate and do not interfere with standard technical measures as defined by Section 512(i).
Send trademark or other intellectual-property complaints outside the DMCA process to [email protected] with the subject "IP Complaint," identifying your rights, the specific material, and the basis of the complaint. Intimate-imagery requests have their own process under Acceptable Use Policy Section 6.
This Policy describes copyright handling for material on the Services. For users who accept the standard Terms, it forms part of the Terms of Service, and material revisions follow Terms Section 17.2. The statutory notice process remains available without requiring a copyright owner to create an account or accept the standard arbitration agreement. Course Pilot terms and executed institutional agreements govern their respective relationships; they do not displace applicable copyright law.
